These Terms & Conditions ("Terms") govern (1) your use of our website and (2) any vehicle transportation or related services we provide.

1) Definitions

  • Customer / You: The person or company requesting services.
  • Vehicle: Any car, SUV, truck, van, motorcycle, or other unit we move.
  • Driveaway: The Vehicle is driven on public roads by an authorized driver.
  • Hauling: The Vehicle is transported on a trailer/truck.
  • Order / Booking: A confirmed request for service (email, text, online, or written).
  • Delivery Location: The final address/yard/compound where the Vehicle is delivered.

2) Services We Provide

We provide vehicle relocation services including, but not limited to:

  • Driveaway (driven transport)
  • Truck/trailer hauling
  • Dealer/auction/compound pickups and drop-offs
  • Fleet and commercial relocations

We may refuse service for any Vehicle that is unsafe, unlawful to move, or not reasonably serviceable.

3) Quotes, Rates, and Changes

  • Quotes are based on details you provide (Vehicle type, pickup/delivery, timing, access, condition, etc.).
  • Quotes may change if the details change (address corrections, special handling, oversized vehicles, inoperable condition, waiting time, extra keys, after-hours access, etc.).
  • Taxes may apply where required.

4) Booking Confirmation

A booking is confirmed when we accept your request (written confirmation by text/email is enough). You agree these Terms apply once you book.

5) Customer Responsibilities (Very Important)

You represent and agree that:

  • You are the Vehicle owner or you have full authorization to ship the Vehicle.
  • The Vehicle is road-legal and safe for the selected transport method.
  • You will provide accurate instructions, contacts, access information, and any site rules (auction/compound/dealer).
  • The Vehicle has enough fuel/charge for loading/unloading and/or driveaway (as applicable).
  • Any required documents/plates/permits are available when needed.
  • You will disclose known issues (mechanical problems, warning lights, leaks, low tires, weak battery, modified suspension, etc.).

6) Vehicle Condition & Inspection

  • We may take photos and notes at pickup and delivery.
  • Normal wear and tear is expected (stone chips, minor scratches consistent with road use, etc.).
  • For Driveaway, you acknowledge that road travel adds kilometres and normal road exposure (weather, salt, debris, traffic conditions).

7) Personal Items Inside the Vehicle

Unless we agree in writing:

  • Do not leave valuables, cash, documents, electronics, or fragile items inside the Vehicle.
  • We are not responsible for loss or damage to personal items left in the Vehicle.
  • Overloaded vehicles may be refused or may require extra fees.

8) Keys, Remotes, and Access Cards

  • You must provide the required keys/remotes/access cards for pickup and delivery.
  • If keys are missing, locked inside, or non-functional, additional costs and delays may occur (locksmith, towing, storage, rescheduling).

9) Scheduling, Delays, and Waiting Time

We aim to meet schedules, but you understand delays can happen due to:

  • weather, road closures, traffic, accidents
  • auction/compound processing delays
  • mechanical issues discovered at pickup
  • staff availability, safety concerns, or other events outside our control

If we arrive and cannot access the Vehicle (or the Vehicle is not ready), waiting time fees may apply, and the move may be rescheduled.

10) Inoperable / Unsafe Vehicles

If the Vehicle cannot start, steer, brake, or roll safely (or is unsafe to drive/load), we may:

  • switch the method (driveaway → hauling/tow), with added cost
  • refuse pickup until corrected
  • charge for any wasted trip/time if the Vehicle was represented as operable

11) Subcontracting

We may use qualified third-party drivers or carriers when needed. These Terms still apply to the service.

12) Payment Terms

  • Payment timing and method will be confirmed on your booking (e-transfer, invoice, etc.).
  • Late payments may result in administrative fees, collection efforts, and/or refusal of future service.

13) Cancellations and Rescheduling

  • If you cancel or reschedule after we have dispatched, arrived, or committed resources, you may be charged a cancellation/rescheduling fee reflecting time and costs incurred.
  • If pickup/delivery details change last-minute, pricing may be updated.

14) Claims Process (Damage Concerns)

To be considered, claims must follow this process:

  1. Note any concern at delivery when possible (photos help).
  2. Notify us in writing within 24 hours of delivery with photos and a clear description.
  3. Allow a reasonable opportunity to review details and, if needed, inspect.

We are not responsible for pre-existing damage, mechanical failures, or undisclosed issues.

15) Insurance, Risk, and Limits of Liability

A) General

  • Our liability (if any) is limited to damage directly caused by our proven negligence during the move.
  • We are not responsible for indirect losses (lost profits, rental costs, downtime, missed sales, penalties, etc.).

B) Driveaway-Specific

You understand and agree:

  • Driveaway involves operating the Vehicle under normal road conditions.
  • We are not responsible for mechanical breakdowns due to the Vehicle's condition (overheating, battery failure, tire issues, warning lights, etc.) unless caused by our negligence.
  • If the Vehicle breaks down, you may be responsible for towing/repair costs unless otherwise agreed in writing.

C) Hauling-Specific

  • Loading/unloading requires the Vehicle to be safe to load. Damage caused by hidden defects (weak tie-down points, aftermarket parts, low clearance not disclosed, etc.) may not be our responsibility.

D) Maximum Liability

To the fullest extent permitted by law, any liability is limited to the transport fee paid for that specific move (or the direct reasonable repair cost, whichever is lower), unless a different limit is required by law.

Nothing in these Terms limits liability where it cannot legally be limited (for example, certain cases of gross negligence where applicable).

16) Refusal of Service / Termination

We may refuse or stop service if:

  • you provide false or misleading information
  • there is unsafe conduct, threats, or harassment toward our staff
  • the Vehicle is unsafe/unlawful to move
  • payment terms are not met

17) Website Use

You agree not to misuse our website, attempt unauthorized access, scrape content, or interfere with site operation. Website content may change without notice.

18) Privacy

We may collect and use contact and booking information to provide services, communicate updates, and issue invoices/receipts. We do not sell your personal information. (You can link to a separate Privacy Policy page for more detail.)

19) Intellectual Property

Our name, logo, branding, photos, and site content belong to Drive All Auto and may not be used without permission.

20) Governing Law

These Terms are governed by the laws of Ontario and the applicable laws of Canada, unless a different jurisdiction is required by law.

21) Disputes

Before starting formal legal action, both parties agree to attempt to resolve issues in good faith through written notice and reasonable discussion. If unresolved, either party may pursue available legal remedies.

22) Vehicle Transportation Service Agreement

Upon acceptance of a quote, customers will be required to sign a Vehicle Transportation Service Agreement. This agreement includes the following key terms:

Vehicle Information & Operating Condition

Customers must provide complete vehicle information (year, make, model, VIN) and accurately declare whether the vehicle is running or non-running.

Mechanical Condition & Disclaimer

The Customer acknowledges and agrees that Drive All Auto is NOT responsible for any mechanical or operational failures including but not limited to:

  • Engine failure, transmission failure, battery failure
  • Exhaust issues, fluid leaks, brake failure
  • Suspension or steering issues
  • Overheating or warning lights
  • Any mechanical issues occurring during or after transport

Transport-Related Damage Responsibility

Drive All Auto IS responsible only for new, verifiable physical or body damage caused directly by loading, unloading, or transportation. Pre-existing damage is excluded.

Personal Belongings

The vehicle must be free of personal items. Drive All Auto is not responsible for loss or damage to personal belongings left in the vehicle.

Claims & Acceptance

Any transport-related damage must be noted at the time of delivery. Acceptance of the vehicle without notation constitutes delivery in satisfactory condition.

Agreement Acknowledgment

By signing the Vehicle Transportation Service Agreement, customers confirm that they have read, understood, and agree to all terms and conditions outlined in this agreement and these Terms & Conditions.

23) Updates to These Terms

We may update these Terms from time to time. The version posted on our website at the time of booking will apply to that booking, unless we agree otherwise in writing.
